Our approach
How we handle a spinal cord injury claim
001
Immediate needs
We make sure available benefits and coverage are in place so rehabilitation and equipment are not waiting on the litigation.
002
The medical and functional picture
Level and completeness of injury, prognosis, secondary complications, and — critically — the functional effect on daily life.
003
Quantifying the lifetime cost
Attendant care, equipment and its replacement cycle, home and vehicle modification, therapy, and the medical complications that commonly follow.
004
Resolution
We resolve the claim when it is properly established, and litigate where a fair resolution is not available.
How we can help

What these claims involve

  • Attendant care over a lifetime
Usually the single largest component. It has to be established on the basis of assessed need across a projected lifetime, including how needs change with age.
     Get in touch
  • Equipment and its replacement
Wheelchairs, transfer and pressure-management equipment, adapted vehicles and home modifications all have finite lives. A claim that costs them once is undervalued.
     Get in touch
  • Secondary complications
Pressure injuries, autonomic dysfunction, chronic pain, respiratory and urological complications are foreseeable consequences of the injury and belong in the claim.
     Get in touch
These claims take years to establish properly. That is appropriate.

Four decades of serious injury claims in Calgary and across Alberta.
Worth knowing

Housing and transport are part of the claim

Adapted accommodation and adapted transport are frequently the difference between independence and dependence. They are proper heads of loss and should be assessed by someone qualified to specify them.

Do not resolve early

Spinal cord injury claims resolved in the first year are almost invariably resolved for a fraction of their value, because neither the neurological recovery nor the care requirement is yet known. Settlement is permanent.

Fund the rehabilitation now

Available benefits, existing coverage and public programs can often fund equipment and rehabilitation while the claim proceeds. Identifying them early changes outcomes, not just the claim.

Frequently Asked Questions: Spinal Cord Injury Claims

  • How soon should a spinal cord injury claim be settled?

Not soon. Neurological recovery continues for a considerable period after injury, and the long-term care requirement cannot be assessed until function has stabilised. A claim resolved before then is resolved on guesswork, and once settled it cannot be reopened if needs turn out to be greater.

  • What can be claimed?

Attendant and personal care over a lifetime, equipment and its replacement, home and vehicle modification, therapy and treatment, medication, management of secondary complications, lost earning capacity, and damages for pain and suffering — which in Canada are subject to a judicially set cap, meaning the care and income components are where the value of the claim actually sits.

  • How long do I have to start a claim in Alberta?

In most injury claims the period is two years — but it does not simply run from the date of the incident. It runs from the point at which you knew, or ought reasonably to have known, three things: that you were injured, that the injury was attributable to someone else's conduct, and that it was serious enough to warrant bringing a proceeding. A separate ten-year outer limit runs from when the claim arose, and whichever period expires first governs. Different rules apply to minors and to people under a disability. Because the analysis is fact-specific, the safe course is to ask early rather than assume.

  • What does it cost to hire a lawyer for this?

We act on a contingency fee basis, which means you pay no legal fees unless compensation is recovered. Disbursements — the out-of-pocket costs of running a file, such as medical records, expert reports and court filing fees — and applicable taxes may still apply. We will explain the arrangement in writing before you retain us.
