Disputed and shared liability
Alberta apportions damages where more than one person is at fault, so an insurer has a direct incentive to argue you contributed. Rear-end collisions, left turns and lane changes are frequently contested. The response is evidence — the collision report, vehicle damage, scene photographs and, where warranted, a reconstruction.
The minor injury cap
Damages for pain and suffering are capped in certain minor injury claims — sprains, strains and some whiplash injuries that do not result in a serious impairment. Whether an injury meets that definition is often the central dispute. The cap does not touch income loss, cost of care or out-of-pocket expenses.
Accident benefits and the tort claim
These are two separate things. Accident benefits under your own policy are available regardless of fault and have their own short deadlines. The claim against the at-fault driver is separate. Both need to be handled, and benefits received can affect the tort claim.

What should I do after a car accident in Alberta?
Call 911 if anyone is injured. Get medical attention, even if you feel able to carry on — symptoms often present later, and a gap in treatment is something an insurer will raise. Photograph the scene, the vehicles and the road conditions, and get the names and contact details of any witnesses. Report the collision to your own insurer and file your accident benefits claim form promptly. Be careful about giving a recorded statement to the other driver's insurer before you have advice.
What compensation can I claim?
Depending on the circumstances: damages for pain and suffering, past and future income loss, the cost of treatment and future care, out-of-pocket expenses, and in some cases a claim by family members. What is available turns on the injuries, the evidence and the insurance in place.
How long do I have to start a claim in Alberta?
In most injury claims the period is two years — but it does not simply run from the date of the accident. It runs from the point at which you knew, or ought reasonably to have known, three things: that you were injured, that the injury was attributable to someone else's conduct, and that it was serious enough to warrant bringing a proceeding. A separate ten-year outer limit runs from when the claim arose, and whichever period expires first governs. Different rules apply to minors and to people under a disability, and some claims carry much shorter notice deadlines that are separate from the limitation period. Because the analysis is fact-specific, the safe course is to ask early rather than assume.
